Terms of Use
Sare is not medical advice and not a medical device. It helps you record and remember your pregnancy. It doesn’t diagnose, treat, monitor or prevent any condition, and it doesn’t replace your midwife or doctor. If you’re worried about yourself or your baby, contact them. In an emergency, call your local emergency number (for example 911 in the US, 999 or 112 in the UK, 112 in the EU and Türkiye).
1. These terms
These terms are an agreement between you and [TO FILL: legal entity name, address] (“Sare”, “we”, “us”) for using the Sare app and hellosare.com. By using Sare you accept them. Our Privacy Policy explains how we handle your data.
You must be at least 18, or the age of majority where you live, to use Sare. [TO CONFIRM: minimum age]
2. Not medical advice
- Week-by-week readings, sizes, tool texts and reminders are general information. They are not tailored medical advice. Every pregnancy is different.
- The kick counter, contraction timer, blood pressure log and check-in record what you enter. They don’t tell you whether something is normal or safe. Follow your care team’s advice about when to call them or go to hospital.
- Sare doesn’t check whether a vitamin or medicine is right for you. Take medicines only as your doctor, midwife or pharmacist tells you.
- Trying-to-conceive mode shows an estimate of your next period only. Sare doesn’t predict fertile days and isn’t birth control.
- Reminders are scheduled on your phone and may not arrive (for example, if notifications are off, the phone is off or iOS delays them). Don’t rely on Sare for anything time-critical.
3. Your account
Sare starts without a sign-up, with an account tied to your phone. If you don’t back it up with Apple, Google or email, you can lose access to your records if you lose or reset your phone. Keep your phone and sign-in methods secure; you’re responsible for what happens in your account. An account is for one person.
4. What’s free
Sare is free to download. The core of the app (Today, every tracker and tool, reminders, memories, every week’s reading, your full history and export) is free. Viewing and exporting your own data never needs a subscription.
5. Sare Pro subscriptions
- Plans. Sare Pro is an optional auto-renewing subscription with a yearly plan and a monthly plan. The yearly plan may include a free trial for eligible new subscribers.
- Price and trial. The price in your currency and the length of any free trial are shown in the app and on the App Store before you confirm. Taxes may apply.
- Payment. Payment is charged to your Apple ID when you confirm the purchase, or at the end of the free trial if you start with one.
- Auto-renewal. Your subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged for the renewal within the 24 hours before the period ends.
- Managing and cancelling. Manage or cancel in your iPhone’s Settings › [your name] › Subscriptions, or in Sare: Profile › Subscription › Manage. Cancelling stops the next renewal; you keep Sare Pro until the end of the period you paid for. If you cancel during a free trial, you won’t be charged. Deleting the app or your Sare account doesn’t cancel your subscription.
- Refunds. Purchases are handled by Apple, so refunds are too. Request one at reportaproblem.apple.com. We can’t issue App Store refunds ourselves.
- Restoring. Use Profile › Subscription › Restore purchases with the same Apple ID. Sare Pro belongs to the Sare account it was bought on; sign in to that account on a new phone.
- Price changes. If the price changes, Apple tells you in advance and, where required, asks for your agreement.
- What Pro includes is described in the app. We may improve or change Pro features over time; we won’t take away a paid feature during a period you’ve paid for without a fair reason, and if we do, you can cancel and request a refund through Apple.
If you live in the EU, the UK or Türkiye, your statutory consumer rights, including any right of withdrawal, apply as handled by Apple for App Store purchases.
6. Your content and your photos
- What you add to Sare (records, notes, photos) is yours. You give us only the permission we need to store and sync your records and run the app for you, as the Privacy Policy describes.
- Your photos are stored only on your phone. We don’t have a copy and can’t recover them. Keep them safe with your iPhone’s backup, Also save to Photos, or export. If you delete Sare or lose your phone without a backup, your photos may be lost.
- When you share a keepsake, you choose where it goes. Only share what you have the right to share, and respect other people’s privacy.
7. Acceptable use
Don’t misuse Sare. In particular, don’t: break the law with it; try to access other people’s accounts or our systems without permission; disrupt or overload the service; scrape or copy it with automated tools; reverse engineer it beyond what the law allows; misuse promo codes or creator links; or use Sare’s content to build a competing service.
8. Our content
The Sare name, the Sprig logo, the fruit art, the week-by-week texts and the app’s design belong to us or our licensors. We give you a personal, non-transferable, non-exclusive licence to use the app for your own, non-commercial purposes.
9. Changes and availability
We keep improving Sare, so features may change. We try to keep the service available but can’t promise it will always be uninterrupted or error-free. If we ever stop offering Sare, we will tell you in advance and give you time to export your data.
We may update these terms. If a change matters, we will tell you in the app before it takes effect. If you don’t agree, you can stop using Sare and delete your account.
10. Ending
You can stop using Sare and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, after a warning where reasonable.
11. Warranties and liability
We provide Sare with reasonable care and skill. Apart from that, and to the extent the law allows, Sare is provided “as is”, without other warranties.
To the extent the law allows, we are not liable for indirect or consequential losses, for lost photos or data you didn’t back up, or for decisions you make based on information in the app. Our total liability to you for any claim is limited to the amount you paid for Sare Pro in the 12 months before the claim, or USD 50 if that is higher. [TO CONFIRM with counsel: liability cap]
Nothing in these terms limits liability that can’t be limited by law, such as for death or personal injury caused by negligence, or fraud, and nothing affects your statutory rights as a consumer.
12. Apple
The app is licensed to you through the App Store. Apple’s Licensed Application End User License Agreement (EULA) applies to your use of the app together with these terms; where they differ about the app licence, the more protective term for you applies to the extent the law requires. These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for claims relating to the app (including product liability, legal compliance or intellectual property claims). If the app fails to meet an applicable warranty, you may notify Apple, which may refund the purchase price; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
13. Governing law and disputes
These terms are governed by the laws of [TO CONFIRM: governing law and courts]. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts. Please contact us first; most things can be sorted out quickly.
